Terms of Service

Welcome to Living Story. These Terms of Service (“Terms”) govern your use of the Living Story platform at livingstory.app (the “Service”), operated by Living Story (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account and to keep it up to date.
• You must notify us immediately if you suspect unauthorized access to your account.

3. Your Content

3.1 Ownership

You own your content.All stories, voice recordings, photos, videos, and other materials you upload or create on Living Story (“Your Content”) remain your property. We do not claim ownership of Your Content.

3.2 License to Us

By uploading or creating content on the Service, you grant us a limited, non-exclusive, worldwide license to store, process, display, and transmit Your Content solely for the purpose of providing and improving the Service. This includes:

• Storing your content on our servers and backup systems
• Processing content through AI services (e.g., transcription, summarization)
• Displaying content to family members you have authorized
• Generating books, cards, and other outputs you request

This license ends when you delete Your Content or your account, subject to reasonable backup retention periods (up to 90 days).

3.3 Content Guidelines

You agree not to upload or create content that:

• Violates any applicable law or regulation
• Infringes on the intellectual property rights of others
• Contains malware, viruses, or other harmful code
• Is harassing, threatening, defamatory, or hateful
• Contains child sexual abuse material or exploits minors
• Impersonates another person or entity

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts that repeatedly violate them.

4. Subscriptions and Payments

4.1 Plans

Living Story offers free and paid subscription plans. Details of current plans, pricing, and features are available on our Pricing page.

4.2 Billing

• Paid subscriptions are billed in advance on an annual basis through Stripe.
• By subscribing, you authorize us to charge your payment method at the start of each billing period.
• Prices may change with 30 days' notice. Existing subscribers will be notified before any price increase takes effect.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time. Your access continues until the end of the current billing period.
• We do not provide prorated refunds for partial billing periods.
• If you are unsatisfied within the first 30 days of a new paid subscription, contact us for a full refund.

4.4 Free Plan Limitations

The free plan includes limited storage, entries, and features. We reserve the right to modify free plan limits with reasonable notice. Your existing content will not be deleted if you exceed limits — you simply will not be able to add new content until you upgrade or reduce usage.

5. Family Sharing

• You may invite family members to view and interact with your stories based on the permissions you set.
• You are responsible for ensuring that people you invite are aware that they are accessing shared family content.
• Family members you invite may have AI-powered conversations based on your shared stories.
• You may revoke access for any family member at any time.

6. AI Features

• The Service uses AI to transcribe recordings, generate summaries, power conversations, and create other content. AI-generated content may not be perfectly accurate.
• You are responsible for reviewing AI-generated content before publishing or sharing it.
• Your content is processed by third-party AI providers (Anthropic, Google Gemini, and OpenAI) under data processing agreements. Your content is not used to train their AI models.

7. Gifts

• Gift subscriptions are non-refundable after the gift code has been delivered.
• Gift codes must be redeemed within 12 months of purchase.
• Gift subscriptions include the same features as the corresponding paid plan.

8. Third-Party Integrations

Living Story integrates with third-party services to enhance your experience. By using these integrations, you agree to the following:

8.1 Google Photos

• When you connect Google Photos, you authorize Living Story to access photos you explicitly select through Google's Picker interface.
• We use the Google Photos Picker API with read-only access. We cannot modify, delete, or access photos in your Google Photos library beyond what you select.
• Imported photos become part of your Living Story repository and are subject to these Terms and our Privacy Policy.
• You can revoke Living Story's access to Google Photos at any time through your Google Account permissions at myaccount.google.com/permissions.
• Your use of Google Photos is also subject to Google's Terms of Service.

8.2 Other Integrations

We may offer additional third-party integrations in the future. Each integration will clearly describe what data is accessed and how it is used before you connect it.

9. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Living Story and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

10. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell or redistribute the Service without our permission
• Use the Service to send spam or unsolicited communications

11. Termination

• You may delete your account at any time. Upon deletion, we will remove your data in accordance with our Privacy Policy.
• We may suspend or terminate your account if you violate these Terms, with notice when practicable.
• Upon termination, your license to use the Service ceases. You may request an export of Your Content before account deletion.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy of AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by law, Living Story shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Living Story and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If we cannot reach a resolution, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association, conducted in English. You may opt out of arbitration for claims that qualify for small claims court.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 30 days before changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. General

• These Terms constitute the entire agreement between you and Living Story regarding the Service.
• If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect.
• Our failure to enforce a right or provision does not constitute a waiver.
• These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
